1. Acceptance of Terms

By downloading, installing, or using the Maat Journal mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

We reserve the right to modify these Terms at any time. We will notify users of any material changes via the App or email. Your continued use of the App after such modifications constitutes acceptance of the updated Terms.

2. Description of Service

Maat Journal is an AI-powered voice journaling application that allows users to:

  • Record voice journal entries
  • Receive AI-generated transcriptions of voice recordings
  • Access AI coaching and insights based on journal content
  • Track mood and emotional patterns
  • Store and sync journal entries across devices

3. User Accounts and Registration

To use certain features of the App, you may need to create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use
  • Ensuring your account information is accurate and up-to-date

You must be at least 13 years old to use the App. If you are under 18, you represent that you have parental or guardian consent to use the App.

Age Restrictions and Parental Consent

Maat Journal complies with the Children's Online Privacy Protection Act (COPPA):

  • Users must be at least 13 years old to create an account
  • Users between 13-18 years old must have parental consent
  • We do not knowingly collect personal information from children under 13
  • Parents or guardians may contact us to review, delete, or refuse further collection of their child's information

4. Privacy and Data Protection

Your privacy is paramount. Our data practices are governed by our Privacy Policy, which is incorporated into these Terms by reference. Key privacy features include:

  • Local Storage: Journal entries are primarily stored locally on your device
  • Encryption: All data is encrypted using AES-256 encryption
  • Recovery Phrase: You control access to your data through a 12-word recovery phrase
  • Zero-Knowledge: We cannot access your journal content

For users in the European Union, we comply with the General Data Protection Regulation (GDPR). You have rights to access, rectify, and delete your personal data.

5. AI Processing and Content

Our App uses artificial intelligence to:

  • Transcribe voice recordings to text
  • Provide personalized insights and coaching
  • Analyze mood patterns and emotional trends
  • Generate journaling prompts and suggestions

By using the App, you consent to this AI processing of your content. The AI processing is designed to enhance your journaling experience while maintaining your privacy.

6. User Content and Intellectual Property

You retain all rights to your journal entries and voice recordings. By using the App, you grant us a limited license to:

  • Process your content for AI transcription and analysis
  • Store encrypted copies for backup and sync purposes
  • Provide technical support and troubleshooting

You represent that you have the right to share any content you create using the App and that such content does not violate any third-party rights.

Intellectual Property Rights

Maat Journal and its content are protected by copyright, trademark, and other intellectual property laws:

  • The App, including its design, code, and content, is owned by Blueship Media Limited
  • You may not copy, modify, distribute, or create derivative works without permission
  • You may not use our trademarks or logos without written consent
  • User-generated content remains your property, but you grant us a license to process it for app functionality

Copyright and DMCA

If you believe your copyrighted work has been used inappropriately, please contact us at support@blueship.media with:

  • Description of the copyrighted work
  • Location of the material on our service
  • Your contact information
  • Statement of good faith belief that use is not authorized

7. Acceptable Use

You agree not to use the App to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Harass, abuse, or harm others
  • Attempt to gain unauthorized access to our systems
  • Use the App for commercial purposes without permission
  • Share your recovery phrase with others

8. Security and Recovery

You are responsible for:

  • Safely storing your 12-word recovery phrase
  • Not sharing your recovery phrase with anyone
  • Keeping your device secure and updated
  • Backing up your recovery phrase in a safe location

Important: If you lose your recovery phrase, we cannot recover your journal entries. This is by design to protect your privacy.

9. Service Availability and Updates

We strive to provide reliable service but cannot guarantee uninterrupted availability. The App may be temporarily unavailable due to:

  • Maintenance and updates
  • Technical issues
  • Third-party service disruptions

We may update the App from time to time to improve functionality, security, and user experience.

Force Majeure

We shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters or acts of God
  • Government actions or regulations
  • Internet or telecommunications failures
  • Third-party service provider issues
  • Cybersecurity incidents or attacks

Maintenance and Updates

We may perform maintenance that temporarily affects service availability:

  • Scheduled maintenance will be announced in advance when possible
  • Emergency maintenance may occur without prior notice
  • Updates may be mandatory for continued app functionality
  • We will provide reasonable notice for significant changes

10. Disclaimers and Limitations

Medical Disclaimer: Maat Journal is not a substitute for professional medical advice, diagnosis, or treatment. The App is designed for personal reflection and growth, not medical purposes.

AI Limitations: While our AI strives to provide helpful insights, it may not always be accurate or appropriate for your specific situation.

Service Availability: We provide the App "as is" without warranties of any kind.

Beta Features and Experimental Services

Some features may be in beta or experimental stages:

  • Beta features are provided "as is" without warranties
  • Experimental AI features may be inaccurate or incomplete
  • We may modify or discontinue beta features without notice
  • User feedback helps improve experimental features

Third-Party Services

Our App integrates with third-party services:

  • App store platforms (Apple App Store, Google Play Store)
  • Payment processors (handled by app stores)
  • AI transcription services (OpenAI Whisper)
  • Cloud storage providers (Supabase)

We are not responsible for third-party service availability or functionality.

11. Limitation of Liability

To the maximum extent permitted by law, Maat Journal shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use.

Our total liability shall not exceed the amount you paid for the App, if any.

12. Termination

You may stop using the App at any time. We may terminate or suspend your access to the App if you violate these Terms.

Upon termination, your encrypted data will remain secure and accessible through your recovery phrase, but you may lose access to certain App features.

13. Subscription and Payment Terms

Maat Journal offers both free and premium subscription versions:

Free Version

The free version includes basic journaling features with limited functionality.

Premium Subscription

The premium subscription is available for €4.99 per month and includes:

  • Unlimited voice journaling
  • Advanced AI coaching and insights
  • Comprehensive mood tracking and analytics
  • Priority customer support
  • Advanced journaling prompts and exercises
  • Cross-device synchronization
  • Data export and backup features

Payment and Billing

  • Subscriptions are billed monthly through your app store account
  • Payments are processed by Apple App Store or Google Play Store
  • Subscription automatically renews unless cancelled at least 24 hours before the end of the current period
  • You can manage and cancel subscriptions through your app store account settings
  • No refunds are provided for partial subscription periods

Subscription Changes

We may modify subscription prices with 30 days' notice. Price changes will not affect your current billing period.

14. Governing Law and Disputes

These Terms are governed by the laws of Cyprus. Any disputes shall be resolved through binding arbitration in accordance with the rules of the Cyprus Arbitration and Mediation Centre.

For EU users, you have the right to lodge complaints with your local data protection authority.

Dispute Resolution

Before pursuing formal dispute resolution:

  • Contact us directly at support@blueship.media to resolve issues
  • We will attempt to resolve disputes amicably within 30 days
  • If unresolved, disputes will proceed to binding arbitration
  • Arbitration will be conducted in English in Cyprus

Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration.

Small Claims Exception

You may bring claims in small claims court if they qualify for small claims court jurisdiction.

15. Data Export and Portability

You have the right to export your data:

  • Export all journal entries in standard formats (JSON, TXT)
  • Request data export within 30 days of account deletion
  • Data will be provided in a machine-readable format
  • No additional fees for data export requests

Data Portability

Your data can be transferred to other services:

  • Use your recovery phrase to access data on any device
  • Export encrypted data for backup purposes
  • Transfer data between devices using your recovery phrase
  • Maintain control over your data at all times

16. International Use and Export Controls

Maat Journal is available internationally, subject to local laws:

  • Compliance with local data protection laws
  • Export control regulations may apply
  • Service availability may vary by region
  • Users are responsible for compliance with local laws

EU Compliance

For European Union users:

  • Full GDPR compliance with data processing
  • Right to lodge complaints with local authorities
  • Data processing occurs within the European Economic Area
  • Standard contractual clauses for international transfers
